Terms of Service

1. Acceptance of Terms

By accessing or using any Link Robins services, including Warble (our hosted realtime service for Flarum forums), our developer sandbox environments, our uptime monitoring tools and public status pages, our community forum, blog, and newsletter, and any related offerings (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users of the Service.

2. Accounts

• You must provide accurate and complete registration information and keep your credentials secure.
• You are solely responsible for all activity that occurs under your account, whether or not you authorized such activity. You agree to notify Link Robins immediately of any unauthorized use of your account.

3. Acceptable Use Policy (AUP) and Use of the Service

This section outlines the rules and conditions that govern your use of all services provided by Link Robins LLC. Violation of this AUP may result in the immediate suspension or termination of your service without a refund.

A. Prohibited Content and Activities:

• Illegal or Unlawful: You may not use our Services to host, store, transmit, or link to any content that infringes on copyright/trademarks; phishing sites; malware/viruses; and any form of child exploitation (CSAM). We have a zero-tolerance policy for child exploitation and will report such activity to US federal authorities immediately.
• Harmful or Abusive: Content that promotes terrorism, illegal violence, or provides instructions on how to perform illegal acts.
• Fraudulent: Any content or activity designed to deceive, such as Ponzi schemes, impersonation, or credit card fraud.

B. Transactional Email & Anti-Spam:

Where Link Robins provides a transactional email facility for an environment we run on your behalf, the following rules protect our server reputation and ensure delivery for all clients:

• No Bulk Marketing: You are strictly prohibited from using a built-in outbox for newsletters, bulk marketing, "cold" sales outreach, or any unsolicited email (SPAM).
• List Hygiene: Sending notifications to "bought" or "scraped" email lists is prohibited.
• Consequences: If your instance generates a high volume of "Spam Complaints" or "Bounces," we reserve the right to disable your email outbox immediately to protect the shared reputation of our IP space.

C. Resource and Network Abuse:

Where our platform provides resources (RAM/CPU) for your instance, the following activities are prohibited:

• Unrelated Workloads: You may not use your instance for cryptocurrency mining, folding@home, or running background processes unrelated to its intended purpose.
• Network Attacks: Using your instance to launch Denial of Service (DoS) attacks, port scanning, or any activity designed to disrupt other networks.
• Malicious Code: Intentionally installing or running code, plugins, or extensions designed to scrape data or overwhelm other websites.

D. General Use Obligations:

• Lawful Use: You agree not to use the Service to violate any applicable local, state, national, or international law or regulation.
• Network Integrity: You must not abuse networks, probe systems without authorization, or interfere with the Service’s operation, security, or infrastructure.
• Responsibility for Content: You are solely responsible for the endpoints you monitor (via Link Robins’ monitoring tools) and any content you submit or process through Link Robins services. This includes ensuring that your content and activities comply with all applicable laws and regulations.

4. Notifications & Alerts (Uptime Monitoring)

Alerts provided by Link Robins’ uptime monitoring tools are on a best-effort basis. Delivery times and accuracy may vary due to third-party networks, configuration, and other factors outside of our direct control.

5. Service-Specific Terms

A. Warble (Hosted Realtime):

• Warble provides the realtime connection infrastructure for your forum. Your forum itself remains yours, hosted and operated by you — Warble never stores your forum's database or content.
• Each plan includes a maximum number of concurrent connections. If your community regularly exceeds your plan's capacity, we may ask you to upgrade; realtime delivery above your plan's capacity is not guaranteed.
• The companion extension is free and open source; the hosted service requires an active subscription.

B. Developer Sandboxes:

• Sandboxes are temporary, throwaway environments. They are automatically deleted when the session expires, and their contents are not backed up and cannot be recovered. Do not keep anything in a sandbox you are not prepared to lose.

C. Forum, Blog & Newsletter:

• Content you post to our community forum remains yours; you grant us the license needed to display it on the forum and, where a discussion powers our blog, on our website.
• Account holders receive our newsletter by default. Every email includes a one-click unsubscribe, and the preference can be changed at any time from your account profile.

6. Plans, Fees & Changes

We may offer free and paid plans for various services. Features, limits, and pricing for all services may change with notice as required by law or your specific plan terms. All fees are non-refundable unless otherwise expressly stated.

7. Service Availability

We aim to keep the Service reliable and use 24/7 monitoring of our infrastructure, with public status available at linkrobins.com/status/uptime. In the event of a service interruption, Link Robins commits to using commercial best efforts to restore the Service as quickly as possible, treating critical issues with the highest priority. Unless a separate written agreement states otherwise, the Service is provided without a formal service-level agreement (SLA) or service credit.

8. Intellectual Property and DMCA Policy

The Service, including all websites, software, trademarks, logos, and content (excluding user-submitted content), are owned by Link Robins LLC or its licensors. You are granted a limited, revocable, non-exclusive right to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

DMCA / Copyright Policy:

Link Robins respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged infringement.

To be effective, a notification of claimed infringement must be a written communication that includes:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.
• Information reasonably sufficient to permit us to contact the complaining party (Address, phone number, email).
• A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner.

Repeat Infringers: In accordance with the DMCA and other applicable laws, Link Robins has a policy of terminating, in appropriate circumstances, clients who are deemed to be repeat infringers.

9. Third-Party Services

We may integrate with third-party tools and services (e.g., email providers, webhooks, payment processors, Cloudflare). Your use of those third-party services is subject to their respective terms of service and privacy policies. Link Robins is not responsible for the performance or policies of third-party services.

10. Termination and Enforcement

We may suspend or terminate your access to all or part of the Service for violations of these Terms (including the AUP), non-payment, or where required by law. We reserve the right to remove any content that violates these Terms or is otherwise objectionable in our sole discretion.

• Enforcement: For minor technical issues or resource spikes, we will contact you directly to find a solution. For serious violations (illegal content, active spamming, or network attacks), we reserve the right to suspend or terminate your service without prior notice.
• No Refunds: No refunds will be issued for services terminated due to a violation of these Terms.

You may stop using the Service at any time. Upon termination, your right to use the Service will immediately cease.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINK ROBINS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. LINK ROBINS LLC MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINK ROBINS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF LINK ROBINS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE LIABILITY OF LINK ROBINS LLC TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO LINK ROBINS LLC FOR THE SERVICE DURING THE THREE (3) MONTHS PRIOR TO THE CLAIM.

13. Indemnity

You agree to indemnify, defend, and hold harmless Link Robins LLC and its affiliates, officers, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party right, including any intellectual property or privacy right.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the new Terms on our website or by other reasonable means. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Warner Robins, Georgia, USA, for the purpose of litigating all such claims or disputes.

16. Support Commitment

Support is provided by email. As a veteran-owned business, we bring a mission-first mentality to our operations: if your service goes offline, our commitment is restoration — bringing it back is our absolute priority. We utilize 24/7 monitoring so that if your infrastructure goes offline, we are likely already working on the solution before you even reach out.
